Disability Awareness

What is Disability?

In Australia, the Disability Discrimination Act 1992 (Cth) defines disability, in relation to a person,  as:

  • total or partial loss of the person's bodily or mental functions, or
  • total or partial loss of a part of the body; or
  • the presence in the body of organisms causing disease or illness; or
  • the malfunction, malformation or disfigurement of a part of the person's body; or
  • a disorder or malfunction that results in the person learning differently from a person without a disorder or malfunction; or
  • a disorder, illness or disease that affects a person's thought processes, perception of reality, emotions or judgement, or that results in a disturbed behaviour; and includes disability that:
  • presently exists; or
  • previously existed but no longer exists; or
  • may exist in the future (including because of a genetic disposition to that disability); or
  • is attributed to a person.
Disability also includes behaviour that is a symptom or manifestation of the disability. What you've just read covers the legal definition of disabilities that are both visible and not visible. Specific types of disability include:
  • intellectual disability
  • physical disability
  • sensory disability
  • neurological disability
  • psychosocial disability.
  • The NDIS Act sets out the objects, or goals, for the scheme, which in conjunction with other laws, give effect to Australia's obligations under the Convention on the Rights of Persons with Disabilities. The United Nations Convention on the Rights of Persons with Disabilities (CRPD) says 'persons with disabilities include those who have long term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others
